Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention

A court has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.

The case originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was held in immigration custody.

In her decision, the court noted that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court proceedings center on conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

Conditions of Release

The court, who was overseeing his challenge to removal in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
